
The UAE Labor Code was created by the Ministry of Labor and the Immigration Service, and the main issues of labor relations are regulated by Articles 8 and 12. UAE labor legislation protects the rights of hired workers regardless of their nationality.
The maximum permitted working hours according to Emirati law is 8 hours a day or 48 hours a week. However, considering that the majority of foreigners work in the tourism and hotel business, the working day can be extended to 9 hours, and any additional work must be paid as overtime. All overtime payments are made hourly. The same applies to work on holidays and weekends. There are 10 official holidays in the country, and Friday is the weekend. If an employee has worked for at least 6 months, he is given 2 additional days of leave per month, and after a year, he can take a 30-day paid leave and go home.
A mandatory condition for working in the UAE is a 6-month probationary period, during which the employer can terminate a person's employment by giving 1 day's notice. Basically, this happens for good reasons: the employee is unable to cope with the work, violates internal regulations, or disobeys superiors. If the employment contract is terminated after the probationary period, the employer must give notice of termination no later than 30 days, and if the employee has worked for less than 1 year, the employer may require the return of funds spent on his employment (visa processing, travel to the place of work, etc.). During the probationary period, sick leave is not paid, and after its completion, it is provided for a period of no more than 90 days.
After the end of the labor contract, the employer pays a severance allowance for length of service. It is calculated as the sum of salaries for 21 days worked per year during the first five years, and thereafter as the sum for 30 working days. The total amount of such payments cannot exceed the amount of salaries for 2 years.
After the cancellation of the labor contract, regardless of who initiated it, the employee receives a ban on working in the Emirates for the next 6 months. Entry into the country is carried out with an Employment Visa. Its issuance takes place in the UAE without your participation. It is valid for 60 days and allows you to work only for the employer specified in it.
Upon receipt of the work visa, the date of arrival of the candidate in the UAE is согласовывается and an air ticket is provided for the route from the candidate's country of residence to the UAE. How long does it take from the selection of a resume by the employer to employment?
The timing depends on many factors. On average, from the moment the candidate sends the Application Form to the employer until the invitation for an interview, it takes from 3 days to 3 weeks. If the candidate successfully passes the interview, the work contract is provided within the next 3 days to 3 weeks. From the moment the work contract is signed until the visa is received, it takes from 5 days to 6 weeks. After receiving the visa, departure for work is carried out within 5-14 days.
As a result, the employment process takes from 2 weeks to 2 months from the moment the work contract is signed with the employer.
Is it necessary to undergo a medical examination before departure?
Yes. This is a mandatory requirement of UAE employers. Usually, having test results for tuberculosis, hepatitis (B, C) and AIDS is sufficient, but sometimes the employer provides their own medical form, according to which you must undergo the required medical examination.
