    How does the Agreement on refusal of entry in the territory of the Russian Federation and the Republic of Belarus work?

       Many foreign citizens face unexpected difficulties when trying to enter Belarus, even if they have not formally violated Belarusian laws. One of these surprises may be the ban on entry received in Russia. At first glance, this may seem strange, because we are talking about an offense on the territory of another state. However, there is close cooperation between the two countries, including in matters of migration and legal control.

       The hotline for safe travel and stay abroad has received more frequent requests from foreign citizens, including Ukrainian citizens, to enter the Republic of Belarus and then reside in Belarus if they are banned from entering the Russian Federation.

       The Government of the Russian Federation and the Government of the Republic of Belarus have signed an Agreement on the mutual recognition and enforcement of decisions on refusal of entry into the territory of the States parties to the Agreement dated 03.11.2015 N 299-FZ. This means that if a foreign citizen is banned from entering Russia, then this ban will usually apply in Belarus, and vice versa.

       How it works:

       Mutual recognition:

    Decisions on refusal of entry made by the authorized authorities of one of the countries are recognized by the other country. At the same time, the Agreement stipulates that the competent authority of the State of one Party has the right to allow entry or stay in the territory of its State to a foreign citizen or a stateless person, in respect of whom the authorized body of the State of the other Party has decided to refuse entry, notifying the competent authority of the other country.

       Grounds for refusal:

       Such a decision becomes the basis for refusal to issue visas, entry or reduction of the period of stay in the territory of a certain country.

       The possibility of removing is locked:

       According to the Agreement, a foreign citizen can apply to the competent authority of the country that issued the ban. If the ban is lifted, the second country must be notified.

       In order for a foreign citizen, including a citizen of Ukraine, to lift the ban on entry to Belarus imposed by the Russian Federation, it is necessary to apply to the Department of Citizenship and Migration of the Ministry of Internal Affairs of the Republic of Belarus with a statement justifying the lifting of the ban and submit supporting documents (if any).

       Where can I find out about the ban:

       In Belarus, the presence of an entry ban can be checked through an online service on the website of the Ministry of Internal Affairs. You can also contact the departments of the Department of Citizenship and Migration of the Ministry of Internal Affairs of the Republic of Belarus with a request.

       The above-mentioned Agreement is aimed at ensuring security and law and order on the territory of both countries.
