    Obtaining a permanent residence permit in Belarus for citizens of Russia

       Citizens of the Russian Federation can stay in the territory of the Republic of Belarus without registration for 90 days in a calendar year. After this period, they must obtain a temporary residence permit (TRP) or a permanent residence permit (PRP).

       1) How can Russian citizens obtain a permanent residence permit in Belarus?

       The grounds for obtaining a permanent residence permit are regulated by the Law of the Republic of Belarus dated January 4, 2010, No. 105-Z "On the Legal Status of Foreign Citizens and Stateless Persons". Russian citizens can obtain a permanent residence permit on the basis of:

       • family ties (being a spouse, parent, or child of citizens of the Republic of Belarus permanently residing in Belarus);

       • employment (having an employment contract with a Belarusian organization);

       • family reunification (having the right to family reunification if close relatives already reside in Belarus);

       • having a marriage with a citizen of Belarus;

       • having lived in the Republic of Belarus after obtaining a temporary residence permit for the last five or more years continuously;

       • having been a citizen of the Republic of Belarus previously;

       • investments (investment in the objects of investment activity in the Republic of Belarus);

       • other grounds (in accordance with the legislation of the Republic of Belarus).

       Under the Agreement between the Republic of Belarus and the Russian Federation on ensuring equal rights for citizens of the Republic of Belarus and the Russian Federation to freedom of movement, choice of place of stay and residence in the territories of the member states of the Union State, a simplified procedure for obtaining permanent residence permit is available for Russian citizens. According to this Agreement, the basis for obtaining permanent residence is Russian citizenship.

       2) What document is issued upon obtaining permission to permanently reside in Belarus?

       Russian citizens are issued a residence permit certifying the right to permanent residence and officially confirming identity.

       3) What is the algorithm for obtaining a residence permit in Belarus?

       • Determining the place of residence.

       • Conclusion of a housing lease agreement. The lease agreement is usually concluded for a period of at least one year, which confirms the intention of permanent residence. Or purchasing property.

       • Preparation of documents (passport, application, lease agreement, certificate of no criminal record, medical certificate, documents confirming the grounds for residence).

       The full list of documents is determined by Chapter 12 (Clause 12.7) of Decree of the President of the Republic of Belarus No. 197 of April 19, 2012.

       4) To what authorities are the documents for obtaining permanent residence in Belarus submitted?

       Documents for obtaining permission to permanently reside are submitted to the territorial departments for citizenship and migration of the Internal Affairs Directorate of regional executive committees (city executive committee) at the place of intended residence.

       5) Within what period is the application for obtaining permanent residence considered?

       The application for permanent residence permit is considered within two months from the date of submission of documents.

       6) What decisions can be made after reviewing the application?

       • Issuance of a permanent residence permit;

       • Refusal to issue a permanent residence permit with the reasons for refusal specified.

       7) What are the grounds for refusing to issue a permanent residence permit?

       Refusal may be related to:

       • threat to national security;

       • lack of grounds for obtaining a temporary residence permit;

       • absence of necessary documents or incorrect information provided;

       • non-compliance with residence and employment conditions;

       • committing offenses;

       • non-compliance with the legislation of the Republic of Belarus;

       • being outside the Republic of Belarus for more than 183 days within a year.

       7) Where to appeal the refusal?

       The decision on refusal can be appealed to a higher body of the Ministry of Internal Affairs of the Republic of Belarus or in court.

       The process of obtaining a permanent residence permit in Belarus for citizens of Russia is simplified, but requires careful attention to the paperwork and compliance with deadlines.
