Getting married in Poland. Difficulties and documents
10.11.2022
Marrying a foreign citizen is one of the most popular inquiries to the hotline. It's important to understand that this is a big responsibility, so the issue must be approached seriously. However, if you're sure, it's better to know about the necessary documents and do everything according to the rules.
To marry a citizen of Poland, you need:
1. Your passport with a visa (as proof of legal stay in Poland).

2. Birth certificate and copies, to which you should attach a notarized translation into Polish, made by a sworn translator from the list published on the website of the Polish Ministry of Justice.
3. A certificate that confirms you are eligible to marry and there are no obstacles to doing so (also with a sworn translation). This document confirms that in accordance with the legislation of your country, you can get married in Poland. Such a certificate (in Polish it sounds like "zdolność prawna do zawarcia małżeństwa") can be obtained in Poland by contacting the Embassy of the Republic of Belarus in the Republic of Poland.
And here's what documents you will need to provide for the Belarusian embassy:
- an application for issuing a certificate (must be printed and filled out), following the
link, you can find the application form;
- your Belarusian passport;
- birth certificate;
- a certificate of no marriage, issued by the registry office at the place of residence (registration) in Belarus;
- documents confirming the termination of a previous marriage, if you were previously in one;
- passport or identity card (dowód osobisty) of the future spouse;
- birth certificate of the future spouse;
- documents confirming the termination of the previous marriage for the future spouse (if any).
All documents that you take to the registry office must be translated into Polish and notarized. It is better to carry out this part of the procedure in Poland, since the notary's certification stamp must be in the language of the country where the documents will be used.
It is also better to clarify there whether it is necessary to apostille the documents. An agreement on the provision of legal assistance has been signed between the Republic of Belarus and the Republic of Poland, according to which documents do not need to be apostilled. However, in some cases, the Polish side requires documents with an apostille.
