Section "People Write to Us": labor contract and service agreement, how to open a salary card for a citizen of Russia in the Republic of Belarus

    08.09.2022
In this section, we answer the most popular questions. This time, we will talk about the differences between employment contracts in Poland and figure out how to apply for a salary card if a citizen of Russia comes to work in Belarus.

Umowa zlecenie is one of the types of contracts between an employee and an employer. The name can be translated as a contract-order or contract-commission. This form of contract is concluded if you must complete a certain amount of work or will work for the customer only for a certain period of time.

This contract is one of the most common in Poland – employers often prefer to conclude it if there are at least formal grounds. However, you need to know that when concluding this type of contract:

       - there is usually no pay for overtime hours,

       - there is no limit on working time (including weekends, holidays, night time),

       - there is no limit on working time (including weekends, holidays, night time),

       - the employer may unilaterally change working conditions (unless you have stipulated otherwise in the contract),

       - you will not have paid leave,

       - there will also be no payment in case of illness or injury.

The law expressly prohibits the use of Umowa zlecenie if it is about permanent work.

Now let's look at when a Labor contract (Umowa o pracę) is required. Such a contract is concluded if:

       - the employee has a clear work schedule, he is familiar with it and agrees,?- the employee has a defined workplace,

       - there is an agreed scope of work between the employee and the employer,?- the employee is subordinate to the employer.

Therefore, if you are applying for permanent employment and all of the above points are true, you have grounds for concluding an employment contract (Umowa o prac?).

Let's note right away that Russian citizens can freely open accounts and conclude deposit agreements in Belarusian banks, and also apply for cards even without having a permanent place of work or registration in Belarus.

To apply for a salary card, you need to go to the bank with an identity document and a copy-translation of it into Belarusian (this requirement is not at all financial organizations, you need to clarify at the bank you are going to). The translation must be notarized either by a Belarusian or Russian authority. If you want to remotely manage the card, keep in mind that you will need to get a Belarusian phone number from one of the Belarusian operators, to which all transaction notifications will be sent.
