Минтруда — про договор ЕАЭС по пенсиям трудовых мигрантов, которые "возвращаются жить на родину"

    31.05.2018
The Ministry of Labor explained how the Treaty on Pension Provision for Workers of the EAEU Member States will affect Belarusians if it is adopted and ratified by the union countries. The department notes that in Belarus, the burden on the ФСЗН for financing pensions of migrant workers returning to their homeland will not increase, but will be limited in this case. Recall that earlier an expert in the field of human development and demography explained why the EAEU agreement on guest workers is inconvenient for Belarus.

Preparation of the Treaty on Pension Provision for Workers of the EAEU Member States is currently underway. The department adds that "the basic principle underlying the draft treaty is the principle of proportionality."

The document provides that each of the union countries assumes responsibility for financing future pensions of migrant workers for the periods of work on their territory, as if these citizens resided in the country of employment. "This approach determines that during the period of work, contributions are paid to the pension fund of the state in whose territory the work is performed," the Ministry of Labor explains.

       — At the present stage, the application of the proportional principle is justified from the point of view of the interests of the state as a whole: when migrants return to their homeland, pension expenses for "foreign" service remain with the countries where the labor activity was carried out (with the payment of pension contributions) and are not imposed on the country of residence of the pensioner. At the same time, workers are given the right to receive pension payments from each of the states whose economies they worked for.

If the document is adopted and ratified, Belarus will pay a pension for periods of work on its territory, and pensions for service in the EAEU member states will be paid from the pension funds of those states, the Ministry of Labor explains.

In other words, if a Belarusian worked officially in Russia, then the pension for this period will be accrued in that country. For the same period that he worked in Belarus, the pension will be accrued in our country.

"That is, in the republic, the burden on the social protection fund for financing migrant pensions will not increase, but will be limited," the department notes.

"Won't it happen that those who do not return to Belarus will end up without a pension at all?"

Let us recall that earlier Anastasia Bobrova, head of the Department of Human Development and Demography at the Institute of Economics of the National Academy of Sciences, candidate of economic sciences, noted that the document contains a number of norms that it is inappropriate for Belarus to agree to. «At the same time, in most cases, our compatriots return to their homeland to spend their final years. As a result, the burden on the Social Protection Fund increases», — explains Anastasia Bobrova. In her opinion, Belarus needs to defend the issue of transferring pension insurance funds to the pension fund of the state of which the employee is a citizen — to the country of permanent residence.

       The Ministry of Labor notes:

       — In particular, it was this approach that would lead to an increase in pension obligations of the country of residence. But even if we agree with such a proposal from the author, it is impossible to ensure and monitor the implementation of legislation on the payment of contributions by employers who are non-residents of the Republic of Belarus. It is also impossible to unequivocally determine during the periods of work which of the states will ultimately be chosen by the employee as their place of permanent residence upon retirement. And will it not happen that, having transferred contributions to Belarus, a citizen who has not returned to the republic will be left without a pension at all.

The department notes that «each country that is a member of the EAEU Treaty will ensure the accounting of length of service in its territory and the payment of the earned part of the pension (in the amount provided for by the national legislation of the state where the work took place)».

       — In addition, we cannot ignore the fact that all the basic provisions of the draft (including the payment of contributions to the pension fund of the state of employment) are currently already in force under the Agreement between the Republic of Belarus and the Russian Federation on cooperation in the field of social security (concluded on January 24, 2006, entered into force on March 29, 2007). That is, they are justified and verified by more than ten years of practice of Belarusian-Russian relations in the field of joint pension provision for citizens, — the Ministry of Labor explains. — In general, we note that the main purpose of the Agreement is to form a mechanism that ensures that workers can fully exercise their pension rights earned in the territory of the EAEU member states, regardless of which of these states they will reside in during the pension period.
