    Registration. Temporary stay.

    Relevance as of 11/18/2024

    Foreigners arriving in the Republic of Belarus are required to register with the registration authority at their actual temporary place of stay within ten days.

    Registration is the responsibility of the foreigner.

    In accordance with the concluded international treaties, citizens exempt from registration for a stay in Belarus up to 30 days from the date of entry are:

    • Lithuanian Republic,
    • Estonian Republic,
    • Russian Federation,
    • Ukraine,
    • Republic of Kazakhstan,
    • United Arab Emirates,
    • Republic of Armenia.

    Citizens of the Russian Federation arriving in the territory of the Republic of Belarus are exempt from registration with the competent authorities at their place of stay for 90 days from the date of entry.

    (Agreement between the Republic of Belarus and the Russian Federation on ensuring equal rights for citizens of the Republic of Belarus and the Russian Federation to freedom of movement, choice of place of stay and residence in the territories of the states - participants of the union state dated 01/24/2006 (as amended by the Protocol of 03/03/2015))

    The period of temporary stay in the Republic of Belarus for a foreigner cannot exceed 90 days in a calendar year from the date of first entry into the Republic of Belarus in a visa-free regime, and in a visa regime it is determined by the period of validity of the issued visa.

    According to the concluded international treaties, citizens of Lithuania, Latvia and Poland have the right to stay on the territory of the Republic of Belarus for more than 90 days a year (up to 90 days within 6 months, 180 days within a year) with a visa, and in a visa-free regime - citizens of Ukraine.

    The period of temporary stay of a foreigner includes his actual stay in the Republic of Belarus. If less than 24 hours have passed between the foreigner's entry into the Republic of Belarus and his departure from the Republic of Belarus, each such period is counted as one day in the period of his temporary stay. Therefore, if a foreigner has a multiple-entry visa to the Republic of Belarus for 30 days up to a certain time, and he left and entered the republic twice or more within a day, then each such trip will be counted as one day.

    A foreigner can register in the Republic of Belarus with the following registration authorities at the place of actual temporary stay:

    • internal affairs bodies,
    • Ministry of Foreign Affairs.

    Foreigners who have arranged accommodation in accommodation facilities or in residential rooms in agro-eco-estates on the basis of contracts for возмездного provision of services are not subject to registration regardless of the purpose of their entry into Belarus: tourism, business or private trip.

    Note. Accommodation facilities include rooms and other spaces used by legal entities and individual entrepreneurs to provide accommodation services, such as rooms in hotels, aqua hotels, apart-hotels, motels, spa hotels, hostels, campsites, health organizations, sanatorium and resort organizations, as well as hunters' and fishermen's lodges, chalets, and bungalows.

    Legal entities and individuals, including individual entrepreneurs, no later than three hours after actually providing residential premises for accommodation based on rental agreements, residential rooms in agro-eco-estates based on service provision agreements in the field of agro-ecotourism, garden houses and dachas based on lease agreements, multifunctional premises (business apartments) based on lease agreements, and accommodation facilities based on contracts for paid services to foreigners temporarily staying in the Republic of Belarus for a period of one day or more, submit information about such foreigners to the internal affairs body at the location of the specified residential and other premises.

    The following are registered at the Ministry of Foreign Affairs:

    • Guests of the heads and staff of diplomatic missions and consular offices of foreign states, representations and bodies of international organizations and interstate entities accredited at the Ministry of Foreign Affairs, if these guests reside in the residences of the heads or premises of the said representations, offices, bodies, or in residential premises occupied by their staff;
    • Holders of foreign diplomatic and service (official) passports, other persons recognized by the Republic of Belarus as having diplomatic or official status.

    Important! Foreigners temporarily staying in the Republic of Belarus are obliged to reside in the Republic of Belarus only at the place of temporary stay where they are registered.

    Foreigners who have arrived in the Republic of Belarus for tourism purposes and are traveling within the territory of the Republic of Belarus in accordance with the tour program must register with the registration authority at the place of initial temporary stay for the entire period of the tour. If it is impossible to register a foreigner at the place of initial temporary stay for the entire period of the tour (for example, if according to the tour program the foreigner stays at a hotel in one locality for the first day and spends the remaining days of the tour hiking with overnight stops in different localities in a tent by the river or in the forest), registration must be carried out at the request of the host organization at their legal address.

    If the place of temporary stay changes, foreigners are required to register with the registration authority at the new place of temporary stay within three working days, starting from the day of arrival at the new place of temporary stay.

    Registration requires the personal presence of the foreigner, except for registration at the request of the host organization and registration of a minor foreigner.

    List of DOCUMENTS that foreigners provide to the registration authorities:

    • application;
    • an exit document, or a certificate of registration of an application for refugee status, additional protection, or asylum in the Republic of Belarus, or a certificate of application for refugee status, additional protection, or asylum in the Republic of Belarus, or a certificate confirming the identity of a foreigner — for foreign citizens and stateless persons who have applied for refugee status, additional protection, or asylum in the Republic of Belarus, or a certificate confirming the identity of a foreign citizen or stateless person — for other foreign citizens and stateless persons who do not have exit documents, or a certificate of additional protection in the Republic of Belarus — for foreign citizens and stateless persons who have been granted additional protection in the Republic of Belarus (in the absence of an exit document);
    • insurance policy, or a paper copy of the notification, or a document confirming the existence of a medical insurance contract concluded with a foreign insurance organization — for foreign citizens and stateless persons subject to compulsory medical insurance;
    • a document confirming payment.

    Categories of persons exempt from paying the state fee for registration — foreigners:

    • who have applied for refugee status, additional protection, or asylum in the Republic of Belarus;
    • under the age of 14;
    • who have arrived for tourism purposes;
    • Citizens of Ukraine who arrived in Belarus after February 24, 2022, are once exempt from paying the state fee for registration of temporary stay.

    Foreigners are registered on the day they submit their application.

    Registration, as well as the extension of the registration period for foreigners, are carried out for a period not exceeding the insurance period.

    Registration or extension of the period of temporary stay in the Republic of Belarus may be refused to a foreigner and/or the period of his/her temporary stay in the Republic of Belarus may be shortened, while the validity period of the visa and/or the period of his/her temporary stay are also shortened.

    Grounds for refusal of registration and extension of temporary stay:

    1. Registration or extension of the period of temporary stay in the Republic of Belarus may be refused to a foreigner and (or) the period of his temporary stay in the Republic of Belarus may be shortened if the grounds provided for in the first part of Article 30 of the Law are established (the same as in the case of refusal to issue a visa for entry into the Republic of Belarus or entry into the Republic of Belarus – they are located in the section REFUSAL TO ISSUE A VISA FOR ENTRY OR ENTRY INTO THE REPUBLIC OF BELARUS in clause 1.2. THE PROCEDURE FOR CROSSING THE BORDER.
    2. Registration is refused to a foreigner, the period of temporary stay in the Republic of Belarus of a foreigner is not extended and (or) shortened.:
      • if the grounds provided for in the second part of Article 30 of the Law are established (the same as in case of refusal to issue a visa for entry into the Republic of Belarus or entry into the Republic of Belarus – are found in the section REFUSAL TO ISSUE a VISA FOR ENTRY OR ENTRY INTO THE REPUBLIC OF BELARUS in paragraph 1.2. PROCEDURE FOR BORDER CROSSING;
      • if, when submitting to the relevant state bodies of the Republic of Belarus the documents necessary for making a decision on registration or extending the period of temporary stay in the Republic of Belarus, the foreigner provided false information, submitted documents and (or) information that did not comply with the requirements of the legislation of the Republic of Belarus, including forged, forged or invalid documents;
      • if there are no grounds for his stay in the Republic of Belarus;
      • if a decision on expulsion or a decision on the imposition of an administrative penalty in the form of deportation has been taken with respect to the foreigner, with the exception of registration or extension of the period of temporary stay in the Republic of Belarus in connection with the appeal (protest) of the said decision or resolution.

    The foreigner is obliged to leave the Republic of Belarus within ten days from the date of his notification of the decision to shorten the period of his temporary stay.

    If the period of temporary stay in the Republic of Belarus is reduced and there are no other legal grounds for staying in the Republic of Belarus, a foreigner is obliged to leave the Republic of Belarus within ten days from the date of notification of the decision to reduce the period of temporary stay.

    A foreigner temporarily staying in the Republic of Belarus is obliged to leave the Republic of Belarus before the expiration of the visa or the period of temporary stay established by this Law, if at the time of expiration of these periods the foreigner has not had the period of temporary stay extended or has not received a temporary residence permit or a permanent residence permit.

    Foreigners arriving at a checkpoint to leave the Republic of Belarus who do not have a valid visa are subject to administrative liability for violating the rules of stay in the territory of the Republic of Belarus, as well as the rules of transit travel (transit) through the territory of the Republic of Belarus, and leave the Republic of Belarus using a document for traveling abroad after being held administratively liable without a visa.

    ORDER OF ELECTRONIC REGISTRATION OF FOREIGNERS TEMPORARILY STAYING IN BELARUS

    Since January 2, 2019, it has been possible to electronically register foreign citizens and stateless persons temporarily staying in the Republic of Belarus on the Internet through the unified electronic services portal portal.gov.by, without having to personally contact the internal affairs bodies. This administrative procedure is free of charge and available to foreigners who have entered the Republic of Belarus at checkpoints across the State Border of the Republic of Belarus.

    Foreigners arriving in the Republic of Belarus through the State Border with the Russian Federation must personally contact the citizenship and migration department of the internal affairs body at their place of stay in Belarus for registration.

    Electronic registration can be done using a computer, mobile phone, or tablet with internet access. To do this, you need to go to the website of the unified portal of electronic services through any browser, choose the language, create a personal account using your email address. Then, in the personal account, in the "Available Services" tab, select the "Citizenship and Migration" category. The registration service code for foreigners is 200.12.14.1. After that, you need to order the service and fill out the application. In the application, you need to indicate the foreigner's surname and name in Latin or Cyrillic as written in their passport (one option is sufficient), details of the passport, insurance, date of entry into the country, and the address where they will reside. There is also a column for the visa, but if, for example, a foreigner comes to Belarus under a "visa-free regime," it is not necessary to fill it out. It is also necessary to pay attention to the correct filling out of all mandatory fields. Then you need to check all the data and click the "Submit application" button. Within a few seconds, a message about successful registration should arrive, or the system will recommend contacting the citizenship and migration department if the information does not match. According to the third paragraph of clause 10.15 of Article 285 of the Tax Code of the Republic of Belarus, foreigners are exempt from paying the state fee for registration in the Republic of Belarus in electronic form through the unified portal of electronic services. A foreigner can also be registered on the unified portal of electronic services by their representative (another person) from their personal account by filling out an application with the foreigner's details in electronic form. All foreigners temporarily staying in Belarus must register. The Republic of Belarus has signed agreements with Ukraine, Lithuania, Estonia, UAE, Kazakhstan, Armenia, and Russia, whose citizens can stay in Belarus for up to 30 or 90 days without registration, respectively. If they intend to exceed this period, they need to obtain permission for temporary or permanent residence, depending on the purpose of entry. If foreigners arriving under a "visa-free regime" intend to stay in Belarus for more than 10 days, they will also need to register. The period for which foreigners are registered is regulated by international treaties concluded with different countries. In most cases, it is up to 90 days in a calendar year. Basis:

  • Decree of the Council of Ministers of the Republic of Belarus dated July 5, 2024, No. 476 "On Accommodation Facilities"
  • You will have to contact the citizenship and migration department in person at your place of stay in two cases: if a foreigner wants to extend the registration at the same address, issued in electronic form, or if he arrived in Belarus through the border with Russia.

    A foreigner does not need to have confirmation of electronic registration with them. It is enough to inform, for example, an officer of the border service when leaving the country. If technically possible, you can save a screenshot of the response about successful registration or print out the registration insert, this will speed up the verification procedure.

    TRANSIT PASSAGE

    Transit passage of foreigners through the territory of the Republic of Belarus is carried out with an exit document abroad, subject to the presence of a visa (in visa regime) for a period not exceeding two days from the date of their entry into the Republic of Belarus, except in cases of forced stop due to:

    • natural disasters, accidents and other emergency situations of natural and man-made origin that delay the movement of the vehicle;
    • the need to repair a damaged vehicle;
    • illness or health condition, if, according to the conclusion of the healthcare organization of the Republic of Belarus, the further movement of the foreigner and (or) the person traveling with him is considered dangerous for their life and health;
    • unforeseen delays when changing from one mode of transport to another at the transfer point;
    • the occurrence of other unforeseen circumstances preventing the further movement of the foreigner.

    Foreigners transiting through the territory of the Republic of Belarus must:

    • have funds to cover the costs of their transit (at least 5 base units for each day of transit);
    • traveling by vehicle - follow only roads used for international road traffic;
    • stop for meals, rest, and overnight stays only at points along the route where there are hotels, motels, campgrounds, or designated guarded parking areas (if none are available, the stop for meals, rest, and overnight stays should be made in a populated area located near the route);
    • those traveling by rail – get off at train stations for the time specified in the current schedule;
    • in case of a forced stop in points located in the border zone, promptly inform the border service authorities of the Republic of Belarus (since they do not have the right to stop in the border zone).

    Citizens of the Russian Federation:

    1. Passport of a citizen of the Russian Federation.
    2. Passport of a citizen of the Russian Federation certifying the identity of a citizen of the Russian Federation outside the Russian Federation.
    3. Official passport.
    4. Diplomatic passport.
    5. Seaman's passport (if there is a ship's role or an extract from it).
    6. Certificate of return to the Russian Federation (only for returning to the Russian Federation);

    Citizens of the Republic of Kazakhstan:

    1. Passport of a citizen of the Republic of Kazakhstan.
    2. Official passport.
    3. Diplomatic passport.
    4. Seaman's passport (if there is a ship's role or an extract from it).
    5. Certificate of return to the Republic of Kazakhstan;

    Citizens of the Kyrgyz Republic:

    1. Passport of a citizen of the Kyrgyz Republic of the 1994 model (if there is a completed international page) until the expiration of its validity and the general passport of a citizen of the Kyrgyz Republic of the 2004 model.
