    Employment features for citizens of certain states

    Employment features for citizens of the Russian Federation:

    • have equal rights in terms of remuneration, working hours and rest time, labor protection and conditions, and other issues of labor relations;
    • documents issued in the Russian Federation for the exercise of labor rights and social and labor guarantees for their citizens, or their copies certified in the prescribed manner, are recognized without legalization;
    • labor activity is regulated on the basis of an employment contract (contract) in accordance with the labor legislation of the Republic of Belarus;
    • the calculation of length of service, the age at which citizens are allowed to work, is carried out in accordance with the legislation of the Republic of Belarus;
    • upon termination of the employment contract due to reduction in the number or staff, benefits and compensations established by the labor legislation of the Republic of Belarus are provided;
    • all types of benefits and payments in cases of temporary disability, pregnancy and childbirth, birth of a child, maternity leave and in other cases are provided in accordance with the legislation of the Republic of Belarus.

    Employment features for citizens of the Russian Federation, the Republic of Kazakhstan and the Republic of Armenia:

    • workers from these states carry out labor activities on the basis of an employment or civil law contract without obtaining special permission to work on the territory of the Republic of Belarus;
    • citizens of these states who have arrived for the purpose of working or finding employment (for citizens of the Republic of Armenia - upon conclusion within five days from the date of entry into the Republic of Belarus of employment or civil law contracts with the employer or customer of work (services)) and members of their families are exempt from registration within 30 days from the date of entry into the territory of the Republic of Belarus;
    • in case of early termination of the employment or civil law contract after 90 days from the date of entry into the territory of the Republic of Belarus, workers have the right, without leaving the territory of the host country, to conclude a new employment or civil law contract within 15 days;
    • at the request of the worker (including a former employee), the employer (customer of work (services)) is obliged to issue him/her a certificate free of charge indicating the profession (specialty, qualifications and position), period of work and amount of wages within the prescribed period;
    • social security (social insurance) (except pension) for workers of the member States and family members is provided on the same terms as citizens of the Republic of Belarus.;
    • the income of a worker received by him as a result of employment is subject to taxation in accordance with the legislation of the Republic of Belarus.

    Peculiarities of employment of citizens of the Republic of Azerbaijan:

    • Employment can be carried out both on the basis of an employment contract and on the basis of a civil contract concluded with an employer.;
    • upon termination of employment by a migrant worker or upon early termination of an employment contract, the employer issues to the migrant worker a Certificate including information on the duration of employment and its payment (indicating the amount of salary for each month), as well as payment of income tax on wages, certified by the seals of the employer and the Department of Citizenship and Migration of the Department of Internal Affairs The Regional Executive Committee/the Minsk city Executive Committee police department.

    (Agreement between the Government of the Republic of Belarus and the Government of the Republic of Azerbaijan on labor activity and social protection of citizens of the Republic of Belarus temporarily working in the Territory of the Republic of Azerbaijan and citizens of the Republic of Azerbaijan temporarily working in the territory of the Republic of Belarus).

    Peculiarities of employment of citizens of the Republic of Serbia:

    • An employment contract is concluded directly between an immigrant worker and the employer, in writing, before leaving for the country of employment;
    • the employment contract must also contain information about overtime work, payment for medical examination (before departure to the place of work), compensation for damage in case of loss of health during work;
    • An immigrant worker is given a copy of the employment contract in the languages of the Republic of Belarus and the Republic of Serbia before leaving for his place of work.

    Peculiarities of employment of citizens of Ukraine:

    • for employment in the territory of the Republic of Belarus, in the absence of a permanent residence permit in the Republic of Belarus, a citizen of Ukraine must have a special permit for the right to work in the Republic of Belarus, which is issued at the request of the employer of the Republic of Belarus by the Citizenship and Migration unit of the Department of Internal Affairs;
    • diplomas, certificates of education, relevant documents on conferring titles, academic degrees, grades, qualifications, and other documents necessary for employment, as well as their duly certified translation, are recognized without legalization.;
    • it is possible to carry out labor activity on the territory of another state on the basis of:
      1. an employment contract (contract) concluded between an employer and an employee for a certain period of time;
      2. an agreement concluded between business entities of both states, the purpose of which is to perform a certain amount of work or services on the territory of the State of employment.;
    • Medical care for employees is provided at the expense of employers on equal terms with citizens of the State of employment.

    (Agreement between the Government of the Republic of Belarus and the Government of Ukraine on Labor and Social protection of Citizens of the Republic of Belarus and Ukraine working outside their Countries dated July 16, 1996).

    Employers of the Republic of Belarus who employ citizens of Ukraine and stateless persons who have resided in the Donetsk and Luhansk regions of Ukraine, as a rule, for at least a year and who arrived in the Republic of Belarus to obtain temporary or permanent residence permits and to work in the Republic of Belarus:

    • They are exempt from paying the state fee for issuing permits for attracting foreign labor to the Republic of Belarus and special permits for the right to engage in labor activity in the Republic of Belarus. At the same time, the deadline for making a decision on issuing (refusing to issue) special permits for the right to engage in labor activity in the Republic of Belarus to citizens of Ukraine may not exceed five working days, and the deadline for providing an opinion on the possibility (impossibility) of attracting them is two working days.;
    • has the right to hire citizens of Ukraine without going through the established procedure for recognizing educational documents issued by educational institutions and other organizations of Ukraine.

    Thus, it is not necessary to obtain a special permit for the right to engage in labor activity, it is enough to conclude an employment contract with foreigners.:

    • being permanently resident in the territory of the Republic of Belarus (having obtained a residence permit), which means automatic acquisition of the right to engage in labor, economic and other activities on an equal footing with citizens of the Republic of Belarus;
    • citizens of the Russian Federation, the Republic of Armenia, the Republic of Kazakhstan and the Kyrgyz Republic, who have a special status in the territory of the Republic of Belarus that distinguishes them from other foreigners, as defined by the Treaty on the Eurasian Economic Union.
