If in the relatively recent past, marrying a foreigner seemed hard to achieve, now many more girls are leaving and arranging their lives outside their homeland. The hotline of the NGO "Club of Business Women" for safe departure and stay abroad and combating human trafficking 8-801-201-5555, 113 receives calls and letters asking to tell about the list of documents that need to be issued if you get married abroad.
Girls meet foreigners purposefully, or to improve their language skills. They register on communication sites, show interest in each other and, as a result, want to meet their new acquaintance in person. There are also categories of Belarusians leaving for work or study. In this article, we want to talk about girls who are getting married to Americans.
Recently, the hotline received a letter of the following nature:
"Good afternoon, my niece Victoria is studying in the USA, she is a citizen of Belarus, now she has a student visa, recently a young man (citizen of America) proposed to her and they want to register their marriage. What documents are needed for registration, and what status will my daughter have if they get married?"
In order to get married in the USA, you must first obtain permission from the county office — the mayor's office or the court.
Documents required for marriage in the USA:
- passport;
- birth certificate;
- divorce certificate (if any);
- certificate confirming no criminal record.
All documents from a foreign citizen (except for the passport) must be legalized, i.e. have an apostille, also a certified translation into English and notarized. The translation must be attached to the original document.
The full list of documents must be clarified with the authorities concluding the marriage.
In each specific case, additional documents may be required. In some states, when collecting documents for marriage, foreigners must provide information about vaccinations from Belarus. The medical center in the USA will verify the provided data from Belarus. If some vaccinations are missing (due to discrepancies in the number of vaccinations in the USA and Belarus), they will need to be done at a cost. In America, medical services are quite expensive, so it is more practical to arrange for health insurance.
To have a marriage recognized as valid in Belarus, it is necessary to legalize the marriage registration certificate by affixing an apostille in the USA. Then in Belarus, a certified translation into Russian/Belarusian should be made, and the legalized and translated marriage certificate should be presented to the registry office at the place of registration in Belarus.
The registry office will make the appropriate mark, and a stamp will be placed in the passport indicating the marriage registration.
From that moment, the marriage concluded in the USA will be considered recognized in Belarus.
If we consider the case of a female student separately. After she formalizes the marriage, she needs to apply to the immigration service before the student visa expires to apply for the first green card for two years. Also, the girl must have a document from her fiancé confirming that he will provide sponsorship support to his wife.
Victoria will be able to work only after she receives the green card. And with a green card (even if her student visa expires), she will be able to travel to Belarus.
Then Victoria can apply for a second ten-year green card.
Marriage can be concluded both in Belarus and in America. If a marriage with an American is concluded in our country, then a visa for family reunification is issued through the American embassy.
If a girl resides in Belarus and wishes to conclude a marriage in the USA, she can apply for a fiancée visa to register the relationship. In this case, the marriage in the USA must be concluded within 90 days of arrival.
