    How to properly hire foreign citizens?

    What is a special permit?

    Foreigners who wish to work in Belarus can work subject to obtaining a special permit and concluding an employment contract.

    A special permit is a document confirming the right of an immigrant worker to engage in labor activities under an employment contract with an employer in the Republic of Belarus; the document is issued by the citizenship and migration authorities of the regional executive committees.

    The оформление (issuance) of a special permit and payment for its изготовление (production) is the responsibility of the employer.

    What documents are needed to apply for it?

    To obtain a special permit for a foreign citizen to work in the Republic of Belarus, the employer submits to the citizenship and migration authorities:
    1. An application for a special permit.
    2. A copy of the foreign citizen's passport or travel document. In accordance with Part 2, Paragraph 6 of Article 15 of the Law of the Republic of Belarus dated October 28, 2008, No. 433-Z "On the Fundamentals of Administrative Procedures", documents drawn up in a foreign language must be accompanied by a translation into Belarusian or Russian, нотариально заверенным (notarially certified), unless otherwise provided by legislation on administrative procedures.
    3. A document confirming payment of five basic units for obtaining a special permit.
    Who does not need to apply for a special permit?

    No special permit is required to work in Belarus for citizens of:

    The Russian Federation,

    The Republic of Kazakhstan,

    The Republic of Armenia,

    Kyrgyz Republic,

    foreign citizens with residence permits in the Republic of Belarus, heads of foreign organizations' representative offices and refugees.

    The validity period of the special permit
    The validity period of the permit for highly qualified workers is 2 years, and for other foreign workers it is 1 year. At the end of the validity period of the special permit, if desired by the foreigner and the employer, it can be extended.

    Conclusion of an employment contract.

    After obtaining a special permit, the employer is obliged to conclude an employment contract with the foreign worker and submit it within a month for registration with the department of citizenship and migration. The employment contract is concluded in Russian or Belarusian, as well as in the native or other language understandable to the foreign worker. Any additional agreement is an integral part of the employment contract. If the employment contract has already been registered with the department of citizenship and migration, then the additional agreement to the employment contract is also subject to registration with the department of citizenship and migration. The validity period of the employment contract should not exceed the validity period of the special permit.

    Important. If an employment contract with an immigrant worker is not concluded, the employer will need to return the special permit to the migration department.

    When hiring, a foreigner must present the employer with the relevant documents.

    Employment of a foreigner with two employers at the same time.

    A foreigner can get a job at another job.

    When hiring a foreign citizen who does not have a permanent residence permit in the Republic of Belarus by several employers, he/she must have a special permit to work with each of the employers.

    The procedure for obtaining a special permit will be repeated as in the first case when getting a job. The permit is issued for 1 year and can subsequently be extended for a similar period in the same manner.

    You can work at two jobs in total - not more than 1.5 positions

    Responsibility for violating the rules of employment of foreigners

    Using the labor of a foreigner without obtaining special permission entails a warning or a fine of up to twenty base amounts, and the foreigner himself may be held liable in the form of a fine of up to 50 base amounts or deportation from Belarus.

    Foreigners who want to find employment in Belarus can look for work independently using the National Vacancy Bank, which is located on the website of the State Employment Service. The vacancy bank contains information about available job openings, as well as information about vacancies in organizations in the republic with housing provided.
