Following my husband to Iran

Belarusians are increasingly finding their soulmates outside of Belarus every year. This can be judged by the number of certificates of marital status issued, which are required for registering a marriage abroad. Belarusian citizens (most often women) have started finding their "one and only" among representatives of the East.
When following their heart after their betrothed to distant lands, Belarusian women are sometimes simply unaware of the legal obstacles and conflicts they will have to face.

In the Islamic Republic of Iran, there are two types of marriages: permanent and temporary
Permanent marriage
According to Iranian laws, only a man and a woman who profess the same religion can enter into a permanent marriage. If you conclude a marriage in the Republic of Belarus, upon arrival in Iran, you will need to "sign" again. The fact is that Iran does not recognize marriages concluded in other countries. To apply for a residence permit with the subsequent receipt of a passport of the Islamic Republic, you need to get married again.
Speaking about marriages between citizens of Iran and citizens of other states, first of all, attention should be drawn to the following fact: the Civil Code of this country states that any woman who is a foreigner, whose husband is Iranian, is considered a citizen of Iran. And in the future, the Iranian side considers her solely in this capacity.
To obtain an Iranian passport, the police migration service confiscates foreigners' passports to stamp them as invalid in Iran and hands them over to the national embassies in Iran.
Temporary marriage
It can be issued for a certain period, or it can be indefinite. He is not subject to a number of restrictions related to permanent marriage. Representatives of various religions can also join it. In Iran, it is forbidden to convert from Islam to any other religion, so a Muslim man or a Muslim woman cannot change their religion to that of their wife or husband.
Temporary marriage is a very convenient institution for a Muslim man, as it allows him to take several wives (up to four) at the same time without much red tape. However, if a Muslim man can support them. A woman may enter into only one temporary marriage at a time.
Prenuptial agreement
When entering into a marriage in Iran, the issue of concluding a prenuptial agreement should be seriously considered. This contract is concluded with a notary, and it is necessary to specify important points in it.
Rules for the division of jointly acquired property.
In the absence of this clause, during the dissolution of the marriage, everything will go to the person to whom the property was recorded, even if they were bought exclusively with your money.
The amount of the marriage gift for the woman,
which is called "mehrie", i.e. a man gives his wife a part of his property, money or financial resources. In case of divorce, the husband is obliged to pay you the entire amount of the loan, but in fact this rarely happens. Therefore, you should not rely on mekhrie, it is better to carefully consider the issue of property division.;
Conditions of custody of children.
After the divorce, the child stays with his father. In fact, parenting often falls on the shoulders of parents or in-laws. Therefore, it is better to insist from the very beginning that in the event of a divorce, the children stay with you.;
The right to travel abroad.
By getting married in Iran, you become a citizen of the Islamic Republic. The written consent of the spouse is required to obtain an Iranian passport. Children cannot be taken out without the written consent of their husband.
The right to divorce.
An Iranian woman cannot divorce her husband on her own. Divorce without reason is an exclusive male privilege. Therefore, it is necessary to include a clause in the contract stating that you have the right to unilaterally terminate the marriage. In the absence of this condition, the man has the right to refuse to grant a divorce for as long as he wishes, and the court will be on his side.
According to the laws of the Islamic Republic of Iran, a woman should not remarry immediately after a divorce. She must wait at least three months in order, firstly, to determine whether she is pregnant or not, and if so, to protect the rights of the newborn. On the other hand, the birth of a child can save the family.
