1. 1 Entry of Ukrainian citizens to Belarus

Citizens of Ukraine can come to Belarus, including by transit through the territory of other countries. The checkpoints of Belarus are operating normally.

Checkpoints on the Ukrainian-Belarusian border from Ukraine are not working.

You can enter the Republic of Belarus using a foreign passport (a foreign passport or a passport with biometric data).

The possibility of Ukrainian citizens entering Belarus using internal Ukrainian passports is decided directly at the border by Belarusian border guards.

1. 2 Departure of Ukrainian citizens from the Republic of Belarus

Departure from Belarus to a third country is possible with a passport of a citizen of Ukraine (both biometric and non-biometric). Minor citizens of Ukraine can leave Belarus using their own documents mentioned above or using the passport of one of their parents, in which they must be registered. Also, such a parent's passport must contain a photo of the child from the age of five.

Currently, the border checkpoints on the Ukrainian side are closed.

However, Ukrainian citizens can return to the territory of Ukraine through the Mokrany checkpoint: Brest region, Maloritskiy district, village of Mokrany. IMPORTANT: You can only return on foot through this checkpoint. Additional information and advice on crossing the border on foot can be obtained:

1. 3 Legalization of stay in the Republic of Belarus

Citizens of Ukraine have the right to stay in the territory of the Republic of Belarus for 30 days without registration. If further stay in Belarus is planned, it is necessary to register at the territorial unit for citizenship and migration of the place of residence no later than 30 days from the date of entry into the country.

Registration is carried out on the day of application. To register, you must submit:

- application (issued on the spot);

- a document for traveling abroad (passport);

Citizens of Ukraine and stateless persons who have resided on the territory of Ukraine and arrived in the Republic of Belarus to obtain temporary residence permits are exempt from the state fee once for registration of temporary stay in the Republic of Belarus.

Registration of Ukrainian citizens temporarily staying in the Republic of Belarus via portal.gov.by .

It is free and available to foreigners who have entered the Republic of Belarus at checkpoints across the State Border of the Republic of Belarus. However, registration through the portal is not available if a citizen of Ukraine enters from the territory of the Russian Federation.

The legislation of the Republic of Belarus provides for the possibility for citizens of Ukraine to obtain a permit for temporary and permanent residence in Belarus, with obtaining a residence permit.

Temporary residence in the Republic of Belarus

Temporary residence permits are issued to foreigners, including citizens of Ukraine.:

• if they arrived in the Republic of Belarus to receive or are receiving education in the territory of the Republic of Belarus, for the period of study, but not more than one year;
• if they are spouses, close relatives of citizens of the Republic of Belarus, foreigners permanently residing in the Republic of Belarus, for the period of stay, but not more than one year;
• if they arrived in the Republic of Belarus to engage or are engaged in labor activity, religious, entrepreneurial or other activity in accordance with the procedure established by the legislation of the Republic of Belarus, for the period of stay, but not more than one year;
• in respect of whom guardianship (custody) has been established, for the period of establishment of guardianship (custody), but not more than one year;
• if they are Belarusians, as well as persons identifying themselves as Belarusians, and their descendants, have grounds for acquiring citizenship of the Republic of Belarus or previously had citizenship of the Republic of Belarus, for the period of stay, but not more than one year;
• if they own residential premises in the Republic of Belarus, for the period of stay, but not more than one year;
• if they have applied for asylum or have been granted refugee status, additional protection or asylum in the Republic of Belarus in accordance with the procedure established by legislative acts of the Republic of Belarus, for the period of consideration of the application;
• if they are receiving medical care in stationary conditions in healthcare organizations of the Republic of Belarus or are accompanying a person receiving medical care, for the period of treatment, but not more than one year;

If any of the above grounds for temporary residence apply, you must contact the Department of Citizenship and Migration at your place of stay in the Republic of Belarus.

Permanent residence in the Republic of Belarus (residence permit)

A permit for permanent residence is issued to foreigners who:

• are close relatives of citizens of the Republic of Belarus permanently residing in the Republic of Belarus;
• are persons granted refugee status or asylum in the Republic of Belarus;
• have the right to family reunification;
• have legally resided in the Republic of Belarus for the last five years or more;
• have grounds for acquiring citizenship of the Republic of Belarus by registration;
• previously had citizenship of the Republic of Belarus;
• are employees and specialists needed by organizations in the Republic of Belarus;
• have exceptional abilities and talent or have outstanding achievements for the Republic of Belarus, high achievements in the field of science, technology, culture and sports;
• They are foreign investors who have invested at least one hundred and fifty thousand euros in investment facilities in the territory of the Republic of Belarus.;
• They are ethnic Belarusians or their blood relatives in a direct descending line: children, grandchildren, great-grandchildren born outside the modern territory of the Republic of Belarus.

Application for additional protection or refugee status in the Republic of Belarus

Additional protection in the Republic of Belarus is provided when there is an armed conflict in the native country, and a person's life is at risk if returned, or if there is a threat of death penalty or torture in the homeland.

Additional protection is provided for up to 1 year with the possibility of extension.

Citizens of Ukraine who have been granted additional protection in the Republic of Belarus have the right to:

• obtaining a certificate of additional protection;
• obtaining a temporary residence permit in the Republic of Belarus;
• medical care and employment on an equal basis with foreigners permanently residing in the Republic of Belarus;
• family reunion;
• judicial protection on an equal basis with citizens of the Republic of Belarus;
• enjoyment of other rights on an equal basis with foreigners temporarily residing in the Republic of Belarus;
• Minor foreigners who have been granted additional protection also have the right to education and medical care on an equal basis with minor citizens of the Republic of Belarus.
  
  

Refugee status is granted when a person has left their country due to persecution for the following reasons: political beliefs, race, nationality, citizenship, religion, belonging to a certain social group.

Granting refugee status in Belarus entitles citizens of Ukraine to permanently reside in the Republic of Belarus and have all the socio-economic rights enjoyed by citizens of the Republic of Belarus (the right to medical care, social security, employment, etc.)

1. 4 The procedure for employment of Ukrainian citizens in Belarus

In accordance with the DECREE OF THE PRESIDENT OF THE REPUBLIC OF BELARUS (see pdf)
dated September 14, 2022 No. 326:

Employers of the Republic of Belarus who attract citizens of Ukraine to work in the Republic of Belarus:

• has the right to hire citizens of Ukraine without going through the established procedure for recognizing educational documents issued by educational institutions and other organizations of Ukraine;
• They are exempt from the state fee for the issuance (one–time extension of the validity period) of permits for attracting foreign labor to the Republic of Belarus, special permits for the right to engage in labor activity in the Republic of Belarus (hereinafter referred to as special permits).;
• They are exempt from submitting documents necessary for making a decision on issuing special permits if there is no objective opportunity to submit such documents.

In order to issue special permits to employers of the Republic of Belarus who attract citizens of Ukraine to work in the Republic of Belarus, the conclusion of the Committee on Labor, Employment and Social Protection of the regional (Minsk City) executive committee on the possibility of attracting foreigners to the Republic of Belarus for work is not required.

The deadline for making a decision on the issue, refusal to issue, or one-time extension of special permits may not exceed five calendar days.

Work in Belarus. Design features.

Citizens of Ukraine, as well as citizens of the Republic of Belarus, must present the necessary documents to conclude an employment contract (Article 26 of the Labor Code).

• Citizens of Ukraine (regardless of the regime of stay) are not subject to military registration in the Republic of Belarus, as they are not subject to military duty. Therefore, they do not need to present military registration documents.
• If a citizen of Ukraine has presented a work record issued in Ukraine, or is applying for a job for the first time, the employer issues him a work record of the established sample.

If a citizen of Ukraine submits a work record issued to him during the existence of the USSR (sample of 1938 or sample of 1973), or a work record of the Republic of Belarus sample of 1993 or 1995, issued to him while working for other employers in Belarus, the employer makes entries in such book.

• In Belarus, diplomas, certificates of education, relevant documents on the assignment of titles, grades, qualifications and other documents necessary for employment issued in Ukraine are recognized (without legalization). However, these documents must be submitted with a translation into Belarusian or Russian, certified in accordance with the procedure established in the state in which the citizen of Ukraine permanently resides and from whose territory he migrates to another state (usually Ukraine).

• Foreigners, including citizens of Ukraine working in Belarus, are subject to mandatory state social insurance on the same terms as citizens of the Republic of Belarus.
• With citizens of Ukraine who have a permanent residence permit in the Republic of Belarus, as well as with persons who have equal labor rights to them, an employment contract is concluded subject to the same requirements as with citizens of the Republic of Belarus.
• As for other categories of citizens of Ukraine, the employment contract concluded in the territory of the Republic of Belarus, in addition to the mandatory information and conditions, must also include:

- the procedure, grounds for termination, amendment and extension of the employment contract;

- conditions of moving to Belarus, food, accommodation, and medical care for the employee.

1. 5 Marriage with a citizen of Ukraine

In accordance with Article 229 of the Marriage and Family Code of the Republic of Belarus:

- marriage of foreign citizens and stateless persons in the Republic of Belarus,

229-1 - the conclusion of marriages of citizens of the Republic of Belarus with foreign citizens or stateless persons in the Republic of Belarus,

marriages are concluded in the Republic of Belarus by bodies registering acts of civil status in accordance with the legislation of the Republic of Belarus, subject to the provision of documents and (or) information provided for by the legislation of the Republic of Belarus on administrative procedures.

The procedure and conditions for marriage registration are the same for everyone, regardless of nationality.

When applying for marriage, citizens of Ukraine permanently residing in the Republic of Belarus submit a residence permit in the Republic of Belarus to the Registry Office. If citizens of Ukraine temporarily stay in the Republic of Belarus, they present to the registry office a national passport with a note on registration in the Republic of Belarus at the registration authority at the place of actual residence. Citizens of Ukraine who are recognized as refugees in the Republic of Belarus provide a refugee certificate, and those with additional protection provide a certificate of additional protection in the Republic of Belarus.

Marriage.

Necessary documents submitted to the registry office:

- application for marriage;

-a valid passport with a notarized translation into one of the official languages (Russian/Belarusian);

-confirmation of registration in the Republic of Belarus;

-a document confirming the absence of a registered marriage with another person, issued by the competent authority of Ukraine.

If a citizen of Ukraine does not reside in the territory of his nationality, such a document can be obtained at the Embassy of Ukraine in the Republic of Belarus.

1. 6 Education of Ukrainian citizens in Belarus

Minor citizens of Ukraine temporarily residing in the Republic of Belarus have the right to pre-school, general secondary, and special education on an equal basis with minor citizens of the Republic of Belarus.

Legal representatives who apply to educational institutions and other organizations engaged in educational activities in accordance with the law in order to obtain preschool, general secondary, or special education for minor citizens of Ukraine are exempt from submitting the required documents, including for deciding whether to provide social protection measures for students or whether they are eligible for an external certification. in the absence of an objective opportunity to submit such documents.

Educational institutions have the right to accept citizens of Ukraine for vocational and technical education, secondary specialized education, general higher and special higher education at the expense of the national and (or) local budgets or on payment terms provided for citizens of the Republic of Belarus, if there are vacancies established by the admission plans, by decision of the head, taking into account the results of the interview. with the applicant. 7. 7 Medical care for Ukrainian citizens

In accordance with article 5 of the Law of the Republic of Belarus dated June 18, 1993 "On Health Protection", foreign citizens and stateless persons permanently residing in the Republic of Belarus have the right to affordable medical care on an equal basis with citizens of the Republic of Belarus, including free medical care based on state minimum social standards in the field of public health. healthcare institutions, unless otherwise established by legislative acts and international treaties of the Republic of Belarus.
